Selling Branded Merchandise

Is that allowed on my square store?

 

I have brand new Disney and Starbucks merchandise. Can I sell this on my square store without it being an issue? I dont want to bother signing up for an online store with square only to have it shut down for selling other brand's merchandise.

Smart question. I'll outline what is/isn't allowed below. 

 

You can sell genuine, legally purchased products through your Square store as long as you have the legal right to resell them.
However, if those products include branded merchandise like Disney or Starbucks, you will need to be careful. Square’s Terms of Service prohibit selling items that infringe on another company’s intellectual property or trademarks. Long story short, it depends on where your merchandise came from and how you’re representing it.

 

What’s allowed

Authorized resale:
If you purchased the Disney or Starbucks items from an authorized distributor, retailer, or wholesaler with the right to resell them, you can generally list them as “authentic” and “resale items.”

 

Personal collection resale:
If these are items you personally bought (e.g., from a Disney Store, Starbucks shop, or official retailer) and you’re reselling them as “new, unused”, that’s typically fine. Similar to selling on eBay or Mercari.

 

Just make sure:

  • You don’t use official brand logos in your website design, product titles, or banners in a way that implies partnership or endorsement.

  • You describe them accurately. e.g., “Authentic Disney mug – purchased from official Disney Store” rather than “Official Disney® product” or “Disney Store™ partner.”

What’s not allowed

Selling counterfeit, replica, or unauthorized branded goods, even if you didn’t realize they were unofficial.


Claiming affiliation or partnership with Disney, Starbucks, or any trademarked brand unless you are licensed.


Using their logos or imagery in your site’s design or marketing (e.g., banners, watermarks, domain names like “DisneyDeals.square.site”).

Square,like Shopify, Etsy, and other platforms, is required by law and their card processors to take down stores that violate trademark or copyright policies.

 

From the Terms of Service for Square: 

“You may not use Square’s Services to sell counterfeit goods, infringe upon the intellectual property rights of others, or imply affiliation with a brand without authorization.”

 

So, if your products are legitimately purchased and clearly resold, you’re in the clear.
