Heads up, friends... this one’s important! You might get sued over your marketing texts (and yes, it’s already happening to other boutiques) if you're missing one critical setting.
WHAT'S HAPPENING:
If you’re sending texts and someone can’t call the number back and reach your store, states like Florida and Oklahoma have newer telemarketing laws that some lawyers are interpreting as a reason to file lawsuits.
We are flagging this because it’s actually happening, and the fix (at least in Klaviyo) is super simple!
The fix is they added a call forwarding option so that if a client tries to call that number it rings at the forwarding number you entered. I don't use Klavlyo so I went to square marketing to see if we had the option to add a forwarding number in settings and we don't. Is this something techs are tracking and if not do I just add this to feature request.
This is the article one of our fellow sellers posted for reference. Looks like this is not a new issue but has resurfaced maybe because of a rise in lawsuits happening now. I was just curious if there was anything we can do to make sure we are compliant.
