Client refuses to pay invoice but has a card on file. Can I legally charge the c

Hi, 

 

I’m a private chef, and I had a client who asked me to buy them extra drink drinks, and laundry detergent. They also added on a day of cooking. 
They are now giving me a hard time and not paying the invoice. They did, however, put a card on file. Can I legally charge the card for the amount due. I have receipts to pack everything up

Unfortunately, I am not a lawyer, nor do I play one on TV.  I would recommend contacting an attorney to see if it is legal to do what you are saying.

 

Now, with that being said, and this NOT being legal advice, I think you are in a bit of a bind.   Assuming you had the customer complete the CC Authorization form that Square provides, the wording says this;

 

"I, _______________________________, authorize __________________________________ to charge my credit card
above for agreed upon purchases. I understand that my information will be saved to file for future
transactions on my account."

 

Aagin, I am not an attorney, but reading the words of the authorization, the term "agreed upon" might be your hurdle.   Do you have any proof that the client agreed to pay you back?  Also, you do have a signed copy of the form, yes?

 

I personally hope you get paid somehow.   Nothing worse than being taken advantage of.

 

So to answer your question, I don't know.   Even if there is an attorney on here that would like to provide you free legal advice, I'm guessing that your state/jurisdiction might have different laws.
